Blanket Tariff Waiver


Notice Text:

1. Under Rates FT-A 7, FT-GS 8, LNGS 8, and PAL 12, Transporter waivers its rights and/or customers' obligations under the following provisions of its tariff:

Under Section 15.7 of its General Terms and Conditions, Transporter monitors, on a real-time basis, the inputs and outputs on the system, and while it does not rigidly enforce the daily balancing requirement on the system, it does require balancing if an imbalance would be material to the operation of the pipeline or present the potential either for operational problems or interference with service to other Shippers. With respect to cumulative or monthly imbalances, Transporter is in contact with its Shippers throughout the month and continues to work with them with the following goals: maintaining the minimum possible monthly imbalances, reducing possible arbitrage on the system, and minimizing credit exposure.

2. Under Section 4.6 of the General Terms and Conditions, Transporter agrees to any other period for processing measurement data corrections that all other parties have agreed to.

3. Transporter will waive the provisions of NAESB WGQ Standards 1.3.7 and 2.3.5 in order to make retroactive adjustments for Transporter's errors, reconciliations of operational balancing agreements, and
schedule volume discrepancies identified at interconnecting facilities outside of the NAESB WGQ standard confirmation cycles. In addition, Transporter will accept, for a period of up to three business days after the end of a gas day, retroactive adjustments for customer errors provided that the requested changes (i) are authorized by all affected parties, (ii) improve an imbalance position for the parties impacted, (iii) do not cause scheduled volume discrepancies at interconnecting facilities, (iv) do not cause a nomination to cross restriction, (v) do not provide the potential for system arbitrage, and (vi) do not impact Transporter or other customers in a detrimental manner. All required confirmations must be submitted to Transporter by the close of business on the tenth business day after the end of the applicable gas day.

4. Pursuant to Section 28 of the General Terms and Conditions ("GT&C") of East Tennessee's FERC Gas Tariff, East Tennessee may mutually agree with Shipper to allow Shipper more than thirty (30) days to provide the security required by GT&C Section 6.2 if Shipper needs additional time to provide such security and has demonstrated a good faith effort to provide such security.

5. Pursuant to Section 28 of the General Terms and Conditions of East Tennessee's FERC Gas Tariff, East Tennessee is waiving the requirements in NAESB WGQ Standard No. 0.3.4 that Shipper acknowledge.
