Notice Text:

1. Under Section 5.3(c) of its General Terms and Conditions, unless notice to the contrary is posted in the Critical Notices section of this website, Pipeline is currently allowing customers to revise nominations on a prospective basis under any interruptible Rate Schedule any time prior to the end of the gas day being scheduled, provided that, in Pipeline's reasonable judgment, Pipeline may implement such revision under existing system operating conditions and such revision shall cause no detriment to any other firm or interruptible service.

2. Under Section 1.24 of its General Terms and Conditions, and unless otherwise posted in the Critical Notices section of this website, Pipeline is allowing Customers to deliver gas at city gates and at end-user delivery points in excess of uniform hourly rates so long as such non-ratable deliveries do not pose a threat to the operations of the system or Pipeline's ability to meet its firm obligations.

3. Under Section 28 of its General Terms and Conditions, Pipeline waives its rights and/or customers' obligations under the following provisions of its tariff:

"Under Section 11.1 of its General Terms and Conditions, Pipeline monitors, on a real-time basis, the inputs and outputs on the system, and while it does not rigidly enforce the daily balancing requirement on the system, it does require balancing if an imbalance would be material to the operation of the pipeline or present the potential either for operational problems or interference with service to other Customers. With respect to cumulative or monthly imbalances, Pipeline is in contact with its Customers throughout the month and continues to work with them with the following goals: maintaining the minimum possible monthly imbalances, reducing possible arbitrage on the system, minimizing adverse impacts of cashouts on the FRQ Deferred Account, and minimizing credit exposure.

4. Under Section 4.2 of Rate Schedule MNPAL, Pipeline rejects any nomination by a Customer to use parking or lending service when the balance in Customer's account exceeds the MPQ and/or the MLQ, respectively, or when giving effect to the nomination will result in a balance in Customer's account that exceeds the MPQ and/or the MLQ.

5. Effective December 1, 2005, Maritimes & Northeast Pipeline, LLC (Maritimes & Northeast) is willing to waive the provisions of Section 5.1(a) of its General Terms and Conditions and NAESB WGQ Standards 1.3.7 and 2.3.5 in order to make retroactive adjustments for Maritimes & Northeast's errors, reconciliations of operational balancing agreements, and scheduled volume discrepancies identified at interconnecting facilities outside of the NAESB WGQ standard confirmation cycles. In addition, Maritimes & Northeast will accept, for a period of up to three business days after the end of a gas day, retroactive adjustments for customer errors provided that the requested changes (i) are authorized by all affected parties, (ii) improve an imbalance position for the parties impacted, (iii) do not cause scheduled volume discrepancies at interconnecting facilities, (iv) do not cause a nomination to cross a restriction, (v) do not provide the potential for system arbitrage, and (vi) do not impact Maritimes & Northeast or other customers in a detrimental manner.

6. Unless notice to the contrary is posted in the Critical Notices section of this website, Pipeline is currently permitting a customer to submit revised nominations on a prospective basis under any firm or interruptible Rate Schedule at any time prior to the end of the gas day being scheduled without requiring such customer to submit an hourly schedule of takes for the remainder of the gas day, as required by Sections 5.3(b) and 5.3(c) of its General Terms and Conditions. The hourly flow rates for the intraday nomination are agreed upon by the interconnected parties.

7. Pipeline continues to review its tariff and operations for discretionary action and will post additional acts of discretion under the tariff as identified.
